Taking the Hynes’ Road |
|
A couple from Gipton, Leeds, are in the process of saving their family home from demolition. On 18th November 2008 they were successful in the first stages of High Court proceedings against Leeds City Council.
When Mr Hynes objected to plans in 2003 the council promised the couple that their home would remain standing. But when the council demolished other homes in the street in 2005, they took out a Compulsory Purchase Order on the property.
The couple have owned their home in Oak Tree Mount since the 1990s, and even had building work approved for the house in 2008.
The solicitors acting for the Hynes detailed the council’s ‘Option 4’ for Mr and Mrs Hynes to remain in their home during the demolition of other houses, in order to retain their claim to it.
Mr Justice Cranston then granted a full hearing to decide the outcome of the Hynes’ conflict with the council. The couple now await a date for the hearing.
